Agreement to Terms

By accessing or using the David Resurface website and services, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our website or services.

Services Description

David Resurface provides pool resurfacing, cool deck resurfacing, tile replacement, equipment repairs, and related pool services throughout the Phoenix metropolitan area, including Scottsdale, Glendale, Tempe, Mesa, Chandler, and surrounding communities.

Service Estimates

All estimates provided by David Resurface are valid for 30 days from the date of issue unless otherwise specified. Estimates are based on the information provided and our visual inspection. Final pricing may vary if additional work is required or if conditions differ from those observed during the initial assessment.

Scheduling and Appointments

  • We will make every effort to complete work within the estimated timeframe
  • Project timelines may be affected by weather, material availability, or unforeseen circumstances
  • Customers will be notified promptly of any scheduling changes
  • A 24-hour cancellation notice is required; late cancellations may be subject to a fee

Payment Terms

  • A deposit may be required before work begins on larger projects
  • Final payment is due upon completion of the work unless otherwise agreed
  • We accept cash, check, and major credit cards
  • Late payments may be subject to interest charges as permitted by law

Warranties

David Resurface stands behind our work. Specific warranty terms vary by service type:

  • Pool Resurfacing: Warranty terms depend on the material chosen (e.g., Pebble Tec, plaster)
  • Cool Deck: Workmanship warranty provided
  • Equipment Repairs: Parts and labor warranty as specified at time of service

Warranties do not cover damage caused by improper water chemistry, neglect, abuse, acts of nature, or unauthorized modifications.

Customer Responsibilities

As a customer, you agree to:

  • Provide accurate information about your pool and property
  • Ensure safe access to the work area
  • Keep children and pets away from the work area during service
  • Maintain proper water chemistry following resurfacing (as instructed)
  • Report any concerns about our work within 7 days of completion

Property Access

You authorize David Resurface and its employees or subcontractors to access your property to perform the agreed-upon services. We will treat your property with respect and take reasonable precautions to prevent damage.

Limitation of Liability

To the fullest extent permitted by law, David Resurface shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to our services. Our total liability shall not exceed the amount paid for the specific service giving rise to the claim.

Dispute Resolution

Any disputes arising from these terms or our services shall be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration in Maricopa County, Arizona, in accordance with Arizona law.

Intellectual Property

All content on this website, including text, images, logos, and graphics, is the property of David Resurface and is protected by copyright and trademark laws. You may not reproduce, distribute, or use any content without our prior written permission.

Website Use

You agree not to:

  • Use our website for any unlawful purpose
  • Attempt to gain unauthorized access to our systems
  • Interfere with the proper functioning of our website
